Ethics Session: Advocacy Has Limits -- Boundaries Created by the Model Rules12:20 - 1:50 p.m.High-profile litigation and administrative proceedings over the 2020 election have brought into sharp focus the limits on an attorney's advocacy. This session will explore the relevant Model Rules that govern bringing claims, asserting or controvert legal theories, and presenting facts to a court or to a third party in the course of a client representation, including the requirement that lawyers inform themselves about the facts of their clients’ cases and the applicable law and determine that they can make good faith arguments in support of their client’s position. At what point is a lawyer required to stop asserting a claim or defense? We will also touch on reporting obligations if and when you become aware of potential violations of those ethical rules.
